These terms

These terms apply when you use this website, its tools and its forms. The site is run by Growpath Capital Inc. ("Growpath Capital", "we", "us"). By using the site you agree to these terms. If you do not agree, please do not use it.

You must be at least the age of majority in your province to send us a form, and you must be acting for a business, not for personal, family or household purposes. If you send a form for a business, you confirm you are allowed to act for it.

What we do

Growpath Capital is a funding broker. We help you find offers from funding partners. We do not lend money, and we do not decide who is approved. A funding partner decides, and approval is never guaranteed.

Each funding partner's own agreement governs any funding it provides. If anything on this site differs from that agreement, the agreement applies. We are not a party to it.

What it costs you

You pay us no broker fee. The funding partners we work with pay us a commission. The funding itself has a cost, and a funding partner's offer may include its own fees. We show you the cost in dollars before you decide.

Information, not advice

What we publish here is general information. It is not financial, legal, accounting or tax advice. Consider getting your own advice before you sign a funding agreement.

The cost calculator and the eligibility check are illustrations. They are not offers, quotes or approvals, and they do not mean a funding partner will fund you. Your real factor rate, fees, term and payments come from the funding partner's offer.

Your responsibilities

• Give us accurate and complete information.
• Tell us about any other advances or financing you already pay, before you take on anything new.
• Read the funding partner's agreement, including any personal guarantee, before you sign it.
• Send forms only about your own business, and contact details only for people who agreed to be contacted.

Using the site fairly

Please do not:

• send false, misleading or someone else's information;
• use bots, scrapers or scripts to send forms or copy the site;
• try to get around the bot check, rate limits or other security, or disrupt the site;
• use the site for anything unlawful.

We may block access or ignore requests that break these terms.

Our content

The site's text, design, logo, calculator and guides belong to Growpath Capital or its licensors. You may view and print pages for your own business use. Please do not copy, republish or sell them without our written permission. Growpath Capital and its logo are our trademarks.

Your information

Our privacy policy explains how we collect, use and share what you send us.

Funding partners and other sites

Funding partners are separate businesses with their own terms. We are not responsible for what they offer or decide, or for the content of other sites we may link to.

The site as it is

We work to keep the site accurate and available, but we provide it as it is and as available. We do not promise it will be free of errors or interruptions, or that its information is complete or up to date. Rates, terms and products in the market change.

Limits on our responsibility

To the extent the law allows, Growpath Capital and its directors, staff and service providers are not liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or business opportunity, that comes from using or not being able to use the site, or from relying on its information, calculator or eligibility check.

To the extent the law allows, our total liability to you for any claim about the site is limited to one hundred Canadian dollars (CAD $100).

Nothing in these terms limits any right you have that cannot be limited by law, or our liability for fraud or wilful misconduct.

Indemnity

If you break these terms or the law while using the site, and that causes a claim against us, you agree to cover our reasonable losses and costs from that claim.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. You and we agree that the courts of British Columbia have exclusive jurisdiction over any dispute about them.

General

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms and the privacy policy are the whole agreement between us about using the site. A funding agreement you sign with a funding partner is separate.

Changes

We may update these terms. We will post the new version here and change the effective date at the top. Changes apply from that date and do not affect anything you sent us before it.
